Nudge – The Smart Alarm for Apple Watch

These terms apply to your use of Nudge ("the app"), published by Zenoova ("we", "us"). By downloading or using Nudge, you agree to them.

1. License

Nudge is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add information specific to Nudge. If they conflict with the Standard EULA, the Standard EULA prevails.

2. What Nudge does

Nudge is a smart alarm for Apple Watch. You choose a deadline and a smart window of up to 30 minutes before it. During that window, Nudge looks at signals from your Apple Watch (wrist movement and, if you allow it, heart rate and sleep data) to wake you at a favorable moment, with haptics on your wrist. Nudge also offers a nap mode. The iPhone app is a companion for planning your alarms.

Nudge requires an Apple Watch paired with an iPhone.

3. Not a medical device

Nudge is not a medical device and does not provide medical advice. It does not diagnose, treat or prevent any condition, and it does not detect sleep stages with certainty. If you have concerns about your sleep or your health, talk to a healthcare professional.

4. Alarm reliability

Nudge relies on features of watchOS that are outside our control, such as Smart Alarm sessions, the system's permission to relaunch the app in the background, your watch's battery, whether you wear it, and its haptic settings. We work hard to make Nudge reliable, but we can't guarantee that it will wake you in every circumstance.

Do not rely on Nudge as your only alarm when missing it could have serious consequences (for example a flight, an exam or a medical appointment). Before going to sleep, make sure your watch is charged, worn, and that the alarm is enabled.

5. Acceptable use

You agree not to copy, modify, reverse engineer or redistribute the app, except as allowed by the Standard EULA or by applicable law, and not to use it for any unlawful purpose.

6. Intellectual property

Nudge, its name, icon, design and content belong to Zenoova. Apple, Apple Watch, iPhone and Digital Crown are trademarks of Apple Inc.

7. Privacy

Nudge does not collect personal data. Our Privacy Policy explains how the app uses data on your devices.

8. Warranty and liability

To the extent permitted by law, Nudge is provided "as is" and "as available", without warranty of any kind, and we are not liable for indirect or consequential damages arising from your use of the app, including oversleeping or missed events. Nothing in these terms limits rights you have under mandatory consumer protection laws of your country of residence.

9. Apple

These terms are between you and us, not Apple. Apple is not responsible for Nudge or its content, has no obligation to provide maintenance or support for it, and is a third-party beneficiary of these terms as set out in the Standard EULA.

10. Changes

We may update these terms when the app evolves. We will publish the new version on this page with a new effective date. If you keep using Nudge after a change, the updated terms apply. You can stop using Nudge at any time by deleting it from your devices.

11. Governing law

These terms are governed by the laws of France, without prejudice to the mandatory consumer protection rules of the country where you live.
